The NCLEX-PRO Terms and Conditions written on this webpage shall manage your use of our website, nclex-pro.com accessible at https://nclex-pro.com.
These Terms will be applied fully and affect to your use of this Website. By using this Website, you agreed to accept all terms and conditions written in here. You must not use this Website if you disagree with any of these Website Standard Terms and Conditions.
Minors or people below 18 years old are not allowed to use this Website.
Refund
No refund shall be given after agreeing to these terms and conditions. Fees paid to the governing bodies such as Josef Silny & Associates, Gemalto, New Mexico Board of Nursing, NYSED, Pearson Vue, ceufast.com, PRC and alike can’t be refunded to the applicant. Receipts and proof of transaction to these institutions will be provided to the applicant. The service fee however can be refunded as deemed fair solely by NCLEX-PRO.
Data Retention
NCLEX-PRO will hold on to data pertaining to the NCLEX application for 2 years. Data will be removed from the website after that. Efforts must be made by the applicant to reach out to NCLEX-PRO in order to safekeeping of their data. Data will be retained for 6 months after the candidate had successfully taken the NCLEX-RN. NCLEX-PRO will not be held liable in the event of any unforeseen events such as disaster, calamity, and others that may destroy the server that contains these data.
Intellectual Property Rights
Other than the content you own, under these Terms, NCLEX-PRO and/or its licensors own all the intellectual property rights and materials contained in this Website.
You are granted limited license only for purposes of viewing the material contained on this Website.
Fees
NCLEX-PRO doesn’t cover courier fees, school fees, and other fees outside the inclusion of the service. Below is the summary of the inclusions of the fees for each state.
Additional Fee for Exam Stage Outside Philippines
Testing center outside the Philippines asks for an additional fee. If you are taking the exam outside the Philippines, we will ask for an additional fee to cover the this fee. You can pay the fee here.
Installment Policy for New York State NCLEX Eligibility Stage
The first payment covers the required certificates, portion of service fee, personalized school and PRC packet (Application Packet) and NCLEX-PRO Portal Access. After 30 days, the payment link for the second payment will be sent via email. This covers the application fee and the portion of the service fee. Without settling the second fee payment, the application fee will not be paid. We will not lodge the application to NYSED. There’s no penalty if the second payment will be paid before the 30-day mark. However, we don’t advise for the second payment to be settled for more than 30 days. There’s a risk for the NYSED to dispose of sent requirements if there is no lodged application on their system.
The examination stage fee will be settled once the applicant receives the eligibility from NYSED and he/she decides to move forward in her application.
Retake
For NCLEX New York application, eligibility doesn’t expire therefore only the Examination stage for New York is needed to pay again to NCLEX-PRO if the applicant wishes to move forward with NCLEX-PRO again.
For NCLEX New Mexico, the Application time frame is only 6 months from the start of paying the New Mexico Board of Nursing RN application. If the retake date lapses, the applicant is required to pay the NM BON application fee, criminal background check, Pearson Vue registration, International scheduling fee, and service fee if the applicant wishes to move forward with NCLEX-PRO again. NCLEX-PRO advises the applicant to keep up with the optimized timeline for NCLEX New Mexico application in order to save NM BON application fee and criminal background check.
NCLEX Candidate Report (NCLEX Pass letter)
The copy of NCLEX Candidate report is not included in our services. We do not include the fee for this service because not all applicants pass the NCLEX-RN. It will be unfair if we ask for fees to all the applicants if we are unsure of they will pass. However, we are happy to give instructions to our successful applicant on how to obtain it if they needed it.
Restrictions
You are specifically restricted from all of the following:
- publishing any Website material in any other media;
- selling, sublicensing and/or otherwise commercializing any Website material;
- publicly performing and/or showing any Website material;
- using this Website in any way that is or may be damaging to this Website;
- using this Website in any way that impacts user access to this Website;
- using this Website contrary to applicable laws and regulations, or in any way may cause harm to the Website, or to any person or business entity;
- engaging in any data mining, data harvesting, data extracting or any other similar activity in relation to this Website;
- using this Website to engage in any advertising or marketing.
Certain areas of this Website are restricted from being access by you and NCLEX-PRO may further restrict access by you to any areas of this Website, at any time, in absolute discretion. Any user ID and password you may have for this Website are confidential and you must maintain confidentiality as well.
Your Content
In these Terms and Conditions, “Your Content” shall mean any audio, video text, images or other material you choose to display on this Website. By displaying Your Content, you grant NCLEX-PRO a non-exclusive, worldwide irrevocable, sub licensable license to use, reproduce, adapt, publish, translate and distribute it in any and all media.
Your Content must be your own and must not be invading any third-party’s rights. NCLEX-PRO reserves the right to remove any of Your Content from this Website at any time without notice.
No warranties
This Website is provided “as is,” with all faults, and NCLEX-PRO express no representations or warranties, of any kind related to this Website or the materials contained on this Website. Also, nothing contained on this Website shall be interpreted as advising you.
Limitation of liability
In no event shall NCLEX-PRO, nor any of its officers, directors and employees, shall be held liable for anything arising out of or in any way connected with your use of this Website whether such liability is under contract. NCLEX-PRO, including its officers, directors and employees shall not be held liable for any indirect, consequential or special liability arising out of or in any way related to your use of this Website.
Indemnification
You hereby indemnify to the fullest extent NCLEX-PRO from and against any and/or all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the provisions of these Terms.
Severability
If any provision of these Terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.
Variation of Terms
NCLEX-PRO is permitted to revise these Terms at any time as it sees fit, and by using this Website you are expected to review these Terms on a regular basis.
Assignment
The NCLEX-PRO is allowed to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.
Entire Agreement
These Terms constitute the entire agreement between NCLEX-PRO and you in relation to your use of this Website, and supersede all prior agreements and understandings.
Governing Law & Jurisdiction
These Terms will be governed by and interpreted in accordance with the laws of the State of Philippines, and you submit to the non-exclusive jurisdiction of the state and federal courts located in Philippines for the resolution of any disputes.
